Terms governing access to and use of KPM Technology software, websites, visualizers, and related services.

Agreement to These Terms

These Terms of Service govern access to and use of websites, software, visualizers, demonstrations, and related services provided by KPM Technology LLC, including Cabinet Visualizer and Floor Coating Visualizer.

By accessing or using KPM Technology services, purchasing a subscription, or otherwise using our software, you agree to these Terms.

Business customers may also be required to enter into a separate Software Subscription Agreement with KPM Technology. If a signed subscription agreement contains terms that conflict with these website Terms, the signed agreement will control with respect to that customer's subscription.

1. KPM Technology Services

KPM Technology LLC develops and provides hosted visualization software and related services for contractors and home improvement businesses.

Services may include Cabinet Visualizer, Floor Coating Visualizer, embedded website visualizers, showroom visualizers, lead generation systems, AI image generation, company branding, product catalogs, administrative controls, usage tracking, customer setup, and related software services.

Features and functionality may vary depending on the product, subscription package, account configuration, and services purchased.

2. Subscriptions

Unless otherwise agreed in writing, KPM Technology subscriptions are month to month.

A subscription provides a limited right to access and use the applicable hosted KPM Technology service while the subscription remains active and all required fees are paid.

Purchasing a subscription does not transfer ownership of KPM Technology software, source code, systems, intellectual property, or technology to the customer.

3. Billing and Automatic Renewal

Subscription fees are generally billed monthly in advance. Subscriptions automatically renew each month until cancelled.

By purchasing a recurring subscription, the customer authorizes KPM Technology and its payment processor to charge the applicable subscription fees and other authorized charges using the selected payment method.

Customers are responsible for maintaining accurate billing and contact information.

KPM Technology may suspend or terminate access if a payment is declined, disputed, reversed, charged back, or otherwise not received when due.

4. Cancellation

Customers may cancel a month to month subscription at any time. Cancellation prevents future subscription renewals.

Unless KPM Technology states otherwise in writing, access will continue through the remainder of the billing period that has already been paid.

Cancellation does not create a refund or credit for the current billing period.

5. Refund Policy

Except where required by applicable law, monthly subscription payments are nonrefundable once charged.

No refunds or prorated credits are provided for partial months, unused visualizations, unused image generations, unused features, early cancellation, or failure to use the service.

Setup, configuration, and onboarding fees are nonrefundable once KPM Technology has begun configuration, onboarding, customization, or other setup work for the customer.

6. Usage Limits

Subscription plans may include monthly image generation allowances, visualization limits, usage limits, or other plan restrictions.

Unused monthly usage does not roll over unless KPM Technology expressly states otherwise in writing.

KPM Technology may require a plan upgrade, restrict generation, temporarily suspend functionality, or apply applicable overage charges when usage exceeds the customer's selected plan.

7. Company Keys and Account Responsibility

Customers may receive a company key, account identifier, hosted visualizer link, embed code, administrative access, or other credentials used to connect the service to the customer's business.

Customers are responsible for activity and usage generated through their assigned company key, account, embedded visualizer, employees, contractors, customers, website visitors, or other authorized users.

Customers must use reasonable care to protect administrative credentials and other nonpublic account information.

8. Customer Content

Customers retain ownership of their photos, logos, branding, catalogs, product information, reference images, business information, and other content supplied to KPM Technology.

Customers grant KPM Technology permission to host, transmit, store, process, resize, analyze, and otherwise use Customer Content as reasonably necessary to provide, operate, secure, troubleshoot, improve, and support the service.

Customers represent that they have the rights and permissions necessary to provide and use any content uploaded or submitted to KPM Technology.

9. Customer Photos and Consent

Customers are responsible for obtaining any notices, permissions, or consents required before uploading photographs, project information, personal information, or other materials belonging to their own customers.

KPM Technology is not responsible for a customer's failure to obtain permission to upload or process third party content.

10. AI Generated Visualizations

KPM Technology services may use artificial intelligence and image processing technology to create conceptual project previews.

Visualizations are intended for design exploration, marketing, sales discussion, and helping customers understand potential project options.

Generated visualizations may differ from actual finished work. Colors, stains, wood grain, paint sheen, materials, textures, flake blends, coating finishes, lighting, shadows, dimensions, perspective, product appearance, and installation results may vary.

Customers and contractors are responsible for verifying final selections, specifications, measurements, materials, samples, product availability, installation methods, and customer approvals before performing work or ordering materials.

11. No Sales or Business Guarantee

KPM Technology does not guarantee that use of its software will increase leads, appointments, estimates, sales, closing rates, revenue, customer satisfaction, search rankings, marketing performance, or business growth.

Business results depend on many factors outside KPM Technology's control, including website traffic, advertising, sales practices, pricing, reputation, market conditions, project quality, and customer demand.

12. Acceptable Use

KPM Technology services may only be used for lawful purposes.

Users may not:

  • Attempt unauthorized access to KPM Technology systems
  • Bypass security or usage controls
  • Interfere with or overload the service
  • Upload unlawful, malicious, infringing, or deceptive content
  • Use the service in violation of privacy or intellectual property laws
  • Scrape or harvest protected platform data
  • Reverse engineer, decompile, copy, or recreate the service
  • Use KPM Technology systems to develop a competing software product
  • Resell or sublicense the service without written authorization

13. Intellectual Property

KPM Technology LLC owns and retains all rights in its software and technology, including source code, object code, application architecture, APIs, databases, data structures, AI prompts, prompt engineering, workflows, user interfaces, visual designs, templates, algorithms, business logic, documentation, trademarks, service marks, improvements, modifications, and derivative works.

Payment for a subscription, setup, customization, or other service does not transfer ownership of KPM Technology intellectual property.

14. Website Embedding

KPM Technology may provide customers with hosted links or iframe embed code for use on customer websites.

Customers may embed the visualizer only on websites they own, control, or are authorized to manage.

Customers may not sell, rent, sublicense, redistribute, or present KPM Technology software as a separately owned competing product without written authorization.

15. Service Availability and Changes

KPM Technology will use commercially reasonable efforts to maintain its services but does not guarantee uninterrupted, error free, or continuous availability.

Service interruptions may occur because of maintenance, updates, hosting issues, artificial intelligence provider outages, internet failures, database issues, payment provider issues, security events, or other circumstances outside KPM Technology's reasonable control.

KPM Technology may update, modify, replace, add, or remove features as necessary for product development, security, performance, cost control, or business operations.

16. Suspension and Termination

KPM Technology may suspend or terminate access for nonpayment, failed payments, chargebacks, fraud, abuse, excessive or unauthorized usage, illegal activity, security risks, attempted reverse engineering, or violation of these Terms or an applicable subscription agreement.

Following termination, KPM Technology may disable company keys, hosted links, embedded visualizers, administrative access, and related services.

17. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KPM TECHNOLOGY SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

KPM Technology does not warrant that the service will be uninterrupted, completely error free, or suitable for every customer's particular business or project requirements.

18. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KPM TECHNOLOGY LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, LOST PROFIT, LOST REVENUE, LOST DATA, BUSINESS INTERRUPTION, REPUTATIONAL, OR SUBSTITUTE SERVICE DAMAGES ARISING FROM USE OF THE SERVICE.

Unless a separate signed agreement states otherwise, KPM Technology's total cumulative liability arising out of or relating to the service will not exceed the subscription fees actually paid by the applicable customer during the twelve months immediately preceding the event giving rise to the claim.

19. Privacy

Information collected through KPM Technology websites and services is handled according to the KPM Technology Privacy Policy.

Customers using KPM Technology software with their own customers are responsible for their own privacy notices, customer consents, and compliance obligations.

20. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles.

To the extent permitted by applicable law, disputes relating to these Terms or KPM Technology services will be subject to jurisdiction and venue in the state or federal courts located in Colorado.

21. Changes to These Terms

KPM Technology may update these Terms from time to time to reflect changes to its products, pricing, technology, business operations, or legal requirements.

The effective date shown at the top of this page identifies the current version. Continued use of the services after revised Terms become effective constitutes acceptance to the extent permitted by applicable law.
